ACT Of Council in favours of the Laird of Strouane.
FOrasmuch, as it being represented to the Lords of His Majesties Privy Council, by a Petition given in to them, by Alexander Robertson of Strouane; That the Petitioner having a considerable Wood upon Lochrannoch, being thirty miles distance, or thereby from the Sea, or any Burgh Royal, which would have been unprofitable, or uselesse to him, or the Countrey; if he had not, with great Expenses and Trouble caused Erect Saw-milnes, in which, these divers years past, there has been made the number of one hundred seventy and six thousand Dails, to the great benefit, and conveniency of the Countrey adjacent, besides the keeping of many Persons at work in the oods, and Milnes: And seing the Petitioner is necessitat to bring down his Cutted Timber by the Loch in Floats, for the space of ten or twelve miles, and that frequently, by the violence of Storms, and Spaits the Floats are broken, and thrown out, upon the several sides of the Loch, and over the Dame-head into the River of Timell, which joyns with Tey, and carried down the Rivers many miles, by the violence of Storms, which gives occasion to the Countrey People, living upon the sides of the said Loch and Rivers, to size upon his Timber, thinking they would be no further lyable, then to a dead Spuilʒie; and many times, after the Supplicant has be [...]towed his utmost coast, and has made his Timber, and Dails; broken and loose People in the Countrey, do fall upon, and carry the same away in the night time: So that the Petitioners Work is thereby likely to be broken, and ruined. And that upon the first day of July, 1675. Upon a Representation made by the Petitioner; the Council did grant an Act in the Petitioners Favours, against any such Invasion: As the Act in it self at more length bears; And which Act, was thereafter, upon severall Considerations stopped, and hath not hitherto taken effect. And whereas the Petitioners Timber, and Dails have been, and are still carried away, and taken up in manner foresaid, to his great hurt and prejudice, unless the said Act be renewed whereby he may have Redress against the Offenders, and Transgressours of the said Act; Therefore humblie Supplicating, That the Council would revive, and renew the foresaid Act, granted in the Petitioners favours, and would give him such further Incouragement, for advancement of the said Publick Work, as they shall think fit. And particularly, that they would intrust him with the oversight of Repairing of the High-wayes, betwixt his Saw-milne in Carrie and Apnadull, and to appoint him Over-seer for the High-wayes, from his Milnes and Woods towards St Johnstoun. The Lords of His Majesties Privy Councill, having heard and considered the foresaid Petition, Do hereby Revive, and Renew the foresaid Act of Councill of the first day of July, 1675. And Ordains the same to be put in Execution, notwithstanding of any Posterior stop given thereto. And do Prohibit, and Discharge all Persons, to Meddle, or Intromet with the Petitioners Floats of Timber, as they come down the Lochrannoch, or the Waters of Timell, or Tey, as they will be Answerable. And incase any of the said Timber, be, by Storms cast out of the Loch, or Rivers foresaids; do hereby Ordain the same to be restored back, by the Intrometters therewith, to the Supplicant, Certifying all who shall keep up the same, for every Cut, or Tree so detained, they shall not only be lyable in the just Value thereof; But also in the Sum of Ten Merks Scots monie, to be payed to him: Certifing also, all such Persons, as shall presume to meddle with, or away take any of the Petitioners Dails after the same are made, That they shall be lyable in the Penalty foresaid, bes [...]de the Value thereof, and be pursued therefore, before His Maj [...]sties Privy Councill, Sheriff of the Shyre, and his Deputs, or any other Judge competent, as the Petitioner shall think fit. And for the Petitioners further Incouragement, The saids Lords do Impower, and Intrust him with the Over-sight of Repairing of the High-wayes betwixt his Saw-milne in the Carrie, and Apnadull. And Ordains his Name to be Insert in the Proclamation anent High-wayes and Bridges as Over-seer for Repairing the High-wayes from his saids Milnes and Woods, towards St. Johnstoun. And do give warrand to the Petitioner, to cause Publication, and Intimation be made hereof, at the Mercat Cross of Perth, and paroch Kirkes next adjacent, and other Places needfull, That none pretend ignorance.
