THE Committee of Estates taking into their consideration that the putting of disaffected and Malignant persons in places of trust or power in the severall Shires and Burghs of the King­dom, And the exercising of that Power to the prejudice of the cause and disturbance of the Peace; Hath occasioned all those present evils unto this Kingdom, And considering that by their former Acts of the 22. of Sept. and fourth of Octob. last, all persons who had been imployed in any publick place or trust, and had been accessory to the late Engagement, or who have subscribed the Bond, or sworn, or subscribed any Oath or Declaration for prosecuting thereof, should forbear the exercise of their places, And be excluded from sitting in Counsells, Committees or other publick Iudicatories as Members or Clerks, Therefore the Com­mittee doth hereby Statute and Ordain, That all Sheiriffs, Bailies of Regalities, Stuarts of Stuartries and their deputies, Magistrates of Burghs, Bailies of Burghs of Barronies, or any other publick Iudge, Minister or Officer either in Burgh or Landward, All Shireff Clerks, Clerks of Stuartries Regalities, Burghs or of Committees of VVarre who have been accessory to the late Engagement, and are culpable of the Crymes con­tained in the said Acts, shall forbear all exercise of their places or trust untill the next en­suing Parliament, and that further order be taken thereanent, And that all persons guilty as aforesaid be discharged from exercising any publick place or trust, VVithout prejudice alwayes to such Lords of Regalities, Stewarts of Stuartries, and others who have power to make their Bailies, Deputies, or Clerks, and are free of the Crymes aforesaid, to substitute others well-affected and qualified Bailies Deputies, and Clerks in the places of these va­cant as aforesaid, But where the persons having Power of making Deputies and Clerks are culpable of the same faults and Crymes, for which their Deputies and Clerks are hereby ordained to be removed, In that case the Committees of VVarre of the severall Shires are to Represent the same to the Committee of Estates, who will take such further Course for appointing others in the places so vacant as they shall think fit, and Ordains these presents to be published at the Mercat Crosse of Edinburgh, and also to be Printed.
