FOrasmuch as her Maiestie doeth vnderstand that the Statutes made heretofore for the maintenance and increase of the Game of Phesants and Partridges, and for the redresse of such abuses, as haue bene and are vsually committed in the waste and spoile of the said Game by disorderly meanes, haue taken and doe take so little effect, as that not onely the obseruation of the said Statutes is vtterly neglected, but greater boldnesse, and a further degree of offence in that kinde is commonly vsed and practised, by taking & killing the said Game by such vnlawfull meanes neere vnto her owne houses of residence; insomuch as her Maiestie is depriued both of the vse, and of the pleasure of the saide Game: Her Maiestie therefore supposing that her straight commandement published by her Proclamation shall take better effect, doeth straightly charge and commaund all and euery person and persons of what degree or estate soeuer, not to take, or cause to be taken with any Netts, Setting dogges or any other Instruments or Engins, any Phesants or Partridges, or any Fowle of the Riuer within sixe miles of any of these her vsuall houses, viz. Windesor Castle, Whitehall, Hampton Court, Richmond, Greenewich, Datelands, or Nonesuch, vpon paine that euery person so offending, shall for the same not onely make such forfeiture, and haue any such other penaltie, as by the sayd Statutes is prescribed, but suffer such further punishment, as by her Highnesse Priuie Councell either in the Court of Starrechamber, or otherwise, for such willfull disobedience and contempt towards her Maiestie shall bee inflicted. And for the better auoyding and preuention of such abuse and disorder, her Highnesse further pleasure and Commaundement is, that no person or persons whatsoeuer, inhabiting or abiding within sixe miles of any of her Houses afore mentioned, shall keepe, or suffer to bee kept within his house any Setting Dogees, Netts, or other Engies for the taking of Phesant or Partridge, or of any Fowle of the Riuer, vpon paine of forfeiture of all such Nettes, Engines, Instruments, or Setting Dogges, and of such further punishment, as by her Maiesties Priuie Councell (as aforesayde) shall for their contempt be imposed.
And lastly whereas her Maiestie both for her exercise and for her delight is pleased many times to see her Hawkes flye, and would more often vse the same, if by the aforesayd disorders, and by the spoyle and disturbance of the Game by the common Hawking neere vnto her Houses, her pleasure therein were not preuented: Her Maiestie doeth likewise straightly charge and command that no person or persons, of what estate or degree soeuer they bee, shall Hawke ax Phesant or Partidge, or at any Fowle of the Riuer, within three miles of any her aforenamed Houses, vnder the degree and qualitie of a Noble man, or of one of her Priuie Councell, vsing the same in their owne person, for their recreation, vpon paine of forfaiting their Hawkes, imprisonment of themselues, and as they will auoyd the further danger of her Maiesties heauy displeasure. And her Maiestie doeth hereby straightly charge all Iustices of Peace, inhabiting within or neere to the precincts aboue limitted to any her Highnesse Houses, that they do carefully looke to the executing of this her pleasure now published, and cause the offenders, whom they shall chance to finde, to be apprehended and committed, and of their faults aduertise some of her Highnesse Priuie Councell, or the Officers of her Greenecloth, for that if it shall appeare that any of the saide Iustices haue vsed negligence, or conniuence herein, her Maiestie will extend the paine of her displeasure vnto them, and cause them to feele the smart thereof.
Giuen at her Maiesties Mannour of Datelands the fifteenth day of September in the foure and fourtieth yeere of her Highnesse raigne.
